Conceptual framework
Contracts are the central theme of CIEL 2019. Contracting is in a state of flux. Emerging technologies are changing the way contracts are negotiated, concluded, managed and executed. The teachings of Behavioral Economics provide new insights into how heuristics, biases, and the architecture of the decision-making framework affect consent. The current landscape implies rethinking how legal and business strategists will have to face these challenges and opportunities.
Renowned experts, academics and professionals will attend CIEL to discuss how contracts can be used to achieve business objectives. The discussion will be guided by a multifaceted approach, based on the following axes:

Smart contracts, Fintech, blockchain technology, and artificial intelligence
How are emerging technologies and innovation changing the way contracts are negotiated, concluded and executed? Can technology help firms to better record and manage their contracts and property rights?
Law and behavioral economics and decision-making architecture
How can the teachings of behavioral economic analysis guide negotiation to achieve business objectives? How can behavioral biases, heuristics, and cognitive limitations affect the decision-making process in a contractual setting? How incentives, default rules and some other tools can be used to achieve business objectives?
Contractual strategy
How can an effective contractual strategy be designed and executed? What is the way to examine agreements from the perspective of law and strategic management?
Contractual governance
What is contractual governance, as a holistic and interdisciplinary proposition, and how can it add value to the design of the contractual structure for complex transactions? How are contractual networks governed?
